About Booking Amount or Best Match Subscription

Droom’s Best Match Subscription (“Subscription”) is a special program through which the buyer gets a curated experience of buying a vehicle and it enables the buyer to submit Requirement, Match, and Buy the desired vehicle according to his/her specific requirements. This allows the buyer to only see the relevant matches against his requirement, and also get assistance from Droom’s Auto Experts in buying the desired vehicle.

A Best Match goes through all aspects for buyer protection by Droom: Verified Seller; Verified Documents; Verified and finally negotiated price; Tentative date and time of delivery; 20-30 additional parameters for buyer protection. This is done to provide the best buyer experience.

The price for this Best Match Subscription is Rs. 499 (inc. GST) for all two-wheeler vehicles and Rs. 999 (inc. GST) for all four-wheeler vehicles. During this program, the buyer has access up to 4 Verified Matches out of the total vehicles matching the requirements within the Subscription period of 30 days from the date of the Best Match Subscription order.

The buyer is eligible for a 100% cashback on the Best Match Subscription Fee of Rs. 499 or Rs. 999 (inc. GST) post a confirmed vehicle delivery.

How to avail this Service?

2. Submit requirements or search existing listings from India’s Largest Vehicle Database
3. Start receiving matches or find what you like or need from existing listings
4. Convert a match or a listing to a Best Match by paying a one-time subscription amount (one Best Match at a time but once the Subscription amount is paid, you can get up to 4 Best Matches)
   Or
   Pay the subscription amount in advance without any existing matches to get up to 4 Verified Matches. In this case, our Auto Experts will assist you in finding the best matches for you.
5. Post receiving the Best Match the buyer has three options: 1) Close the Match 2) Have more questions about Best Match (from the dropdown of topics), or 3) Can request for more Best Matches.
6. The closing team helps in closing, delivery, insurance, payment, loan, RTO documentation, etc.
7. Once the buyer decides to close on a Best Match and pays the refundable Token Amount, the vehicle will be reserved for 120 hrs (5 days). Then the Droom’s Closing Team will contact the buyer for the remaining process related to the transaction and vehicle delivery.
8. Buy and receive the vehicle at your doorstep (seller dependent)
9. 100% Cashback is initiated on Booking Amount (Rs. 499 or 999) post confirmed delivery of the vehicle.

Terms of Use

1. Best Match Program Fee of Rs. 499 (for two-wheeler) and Rs 999 (for car) are inclusive of GST.
2. The validity of Subscription is up to 4 verified Best Matches or up to 30 Days (from the time of purchase), whichever is earlier.
3. Droom will reserve only one Best Match for the buyer at a time for 24 hours and If the buyer decides not to close on that Best Match within 24 hours the best match will expire and will be counted against the total available best matches for the buyer.
4. Post Buyer’s acceptance of Best Match, the seller will have 24 hours to respond to the request, provide additional intimate details of the vehicle. If the seller rejects then it will not be counted as a Best Match. In this scenario, a new Best Match will be provided by Droom, or the buyer can choose to convert a match into best match by directly adding it.
5. Buyer can request more Best Matches post-acceptance/rejection at any point in time (Limited to a maximum of total 4 Matches including the initial match).
6. Buyer can reconsider a previous Best Match after 24 hours but then it will be counted as another Best Match and again it will be reserved for another 24 hrs.
7. Droom uses its latest technologies and know-how of the expert teams to find the Best Matches against each requirement of the buyer, however in some cases, if any specific requirement is not available, the next matching available option will be shown as the Best Match.
8. Post Token Amount Payment on a Best Match, the Final decision should happen within 120 hours of Booking. Once the 120 hours period is complete or the order is marked as Transaction Closed, it will be considered closed.
9. A deal will be deemed as Completed when a buyer makes the final payment to the seller, both Buyer and Seller execute the closure documents, and Seller hands over the vehicle to the buyer.
10. 100% Cashback on Booking Amount is applicable only for the buyer with confirmed vehicle delivery.
11. The Cashback Amount is to be processed within 20 working days from the date of vehicle delivery.

Money Back Guarantee/ Refund of Booking Amount and Token Amount

The Subscription amount paid by the buyer is covered under Money Back Guarantee Program which allows the buyer to be eligible for a full refund in case of a refund claim is raised using the website/app features within the stipulated time period provided. Below are the terms applicable in case of a refund request:-

1. Droom’s refund policy is applicable on the Booking Amount (Rs. 999 0r Rs. 499) and Token Amount (~3% of Selling Price) but not on the complete value of the vehicle or any other amount paid by buyer to Seller during the transaction.
2. Refund requests can be made only post completion of the Subscription period or after consuming all the 4 Best Matches.
3. Following are the only scenarios where Droom may consider the refund under the Money Back Guarantee Program:- 1) Buyer did not receive 4 Best Matches within the subscription period, 2) Buyer is not satisfied with any of the 4 Best Matches.
4. Droom may refund the amount in the shape of store credits or via cheque or any other payment instruments deemed appropriate by Droom from time to time.
5. Droom may change/alter/cancel the refund policy under this Subscription at any given point of time without any prior notice to the buyer.
6. The Buyer will have a maximum of either 120 hours post placing the order or until they mark the order complete, whichever occurs earlier to cancel the order and get a full refund. Once the 120 hours period is complete or the buyer marks the order as complete, the buyer will lose any rights to claim the refund of the amount paid to Droom. This will also cover any attempts to raise a chargeback through the buyer’s bank or the associated payment gateway. No claims shall be entertained by Droom after the abovementioned period(s) expire.
7. Droom shall have the sole liberty to decide whether to initiate refund as per buyers request at it’s sole discretion. Droom will not be liable for any loss/damages incurred by the buyer in case of the refund not provided for any reason(s) whatsoever and the buyer fully indemnifies Droom for all losses/damages/legal costs that might occur or the buyer incurs in case the buyer initiates any action/ proceedings against Droom. All related costs (Including legal expenses ) shall be borne solely by the buyer.

Other Terms

1. If Droom has suspicion or knowledge, that any of its buyers and Sellers are involved in any activity that is intended to provide claims or information that is false, misleading, or not genuine, then Droom may while reserving its rights to initiate civil and/or criminal proceedings against member may also at its sole discretion suspend, block, restrict, cancel the display name and/ or account of such buyer and Seller and /or disqualify that User and any related Users from availing protection through this program or availing any other remedy through the platform.
2. Droom reserves its right to initiate civil and/or criminal proceedings against a User/buyer who files invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid (total cost of which shall be borne by the buyer), Droom may at its sole discretion suspend, block, restrict, cancel the display name [and its related display names] and/ or account of such User and/or disqualify that User and any related users from availing protection through this program. Any person who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
3. In case of transaction of vehicles, the following further conditions will also be applicable:
   1. Buyer and Seller are responsible to follow all the rules and regulations prescribed by RTO.
   2. Buyer and Seller will be responsible for any vehicle insurance required by law.
   3. All additional costs involved for transferring, registration and other services will be borne by the buyer.
4. Buyer should perform his/her own due diligence while meeting the seller and testing the vehicle and documents, Droom does not take any responsibilities of the vehicle condition, authenticity or validity of documents.
5. Full transaction is considered closed once the buyer and seller meet and complete their obligations.
6. Buyer is responsible for reaching out to the seller and coordinating the transaction closure process. Droom solely acts as a platform for connecting the buyer to sellers and Droom in any manner will not be responsible to the buyer in case of any issues related to transactions between the buyer and the seller.
7. Droom in no way shall be responsible in any manner whatsoever for any loss/damages/any obligations arising out of this Subscription model on offer or the Droom website.
8. Buyer will solely be responsible for procuring any documentation(s) that is required by law at his/her own cost. Droom will not be responsible in any manner for procuring/providing any document(s) for the buyer at the time or after the transaction is over between the buyer and the seller.
9. Droom is not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries/information or for inaccurate entry information, or by any technical or human error that may occur; (b) any printing or typographical errors associated with this Subscription; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or on the Website; or (d) injury or damage to any computer or mobile resulting from downloading any materials in connection with the Subscription model on offer by Droom; or (e) for any reasons beyond the control of Droom.
10. Buyer fully indemnifies Droom and it’s website and Subscription for all losses/damages/legal costs that might occur or the buyer incurs in case the buyer initiates any action/ proceedings against Droom in lieu of this Subscription model and/or on any related concern on the website and/or Droom in general. . All related costs (Including legal expenses) shall be borne by the buyer.
11. The vehicle will not be shipped by Droom unless mentioned explicitly otherwise in writing.
12. There may be additional costs involved for transfer, registration and other related services which the buyer will solely incur at his/her own cost.
13. The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions.
14. Droom's decision shall be final and binding on the buyer - In case of any concerns, the buyer may contact the Droom’s dispute resolution team for any issues.
15. Abovementioned terms & conditions shall be construed in accordance with the applicable laws of India. Any or all disputes arising out of this Subscription model on offer shall be subject to the exclusive jurisdiction of the courts of New Delhi only
