General Policies & Rules

Droom’s policies and rules are the common guidelines that create a safe, trusted, and fair trading environment for all Droom members. To promote a safe and trusted trading environment, Droom enforces these policies and rules.

TERMS OF USE:

Terms of Use is the most important Droom policy and rule document. All members are responsible for reviewing and understanding Droom’s policies and all applicable laws and regulations contained in this legal contract.

IRRELEVANT LINKS:

Dealers/Individual sellers are restricted from inappropriately adding links to their  product listings or online storefronts to move traffic away from Droom.

RULES FOR EVERYONE:

Our general policies apply to all listed Dealers/individual sellers/resellers/customers listing their vehicles on www.droom.in as well as Droom employees. This section includes rules that protect your privacy and your identity. Learn more about issues like the use of profanity, unsolicited email (spam), etc. under the Terms of Use of www.droom.in

KEYWORD SPAMMING:

Dealers/individual sellers/resellers/customers are restricted from using any of their own brand names as keywords in product listings to drive attention.

PROHIBITED AND RESTRICTED ITEMS:

Items and products not related to the automobile industry/market are restricted from selling online at www.droom.in. Only automobiles, services, and products related to the automobile industry are sold at Droom.in, anything apart from this is restricted to be sold here. A list of such items is listed below and is not exhaustive. 

RULES ABOUT INTELLECTUAL PROPERTY:

Droom has zero tolerance for any intellectual property violations. Please notify us at our support ID present on most of our policy pages and also in the Terms of Use of www.droom.in. if any violation has occurred without our knowledge, and we will take appropriate action as soon as possible.

SELLER CONTACT POLICY:

Any seller is strictly restricted from sharing his/her contact information in any form with any potential buyer before the buyer pays the token amount.

DROOM RULES AND POLICIES ARE DESIGNED TO:

  1. Minimize risks for both buyers and sellers

  2. Protect intellectual property rights

  3. Support government laws and regulations

  4. Provide an enjoyable buying and selling experience

  5. Provide equal opportunity to all buyers and sellers

Please learn more about Droom’s policies that will help you avoid breaking rules (including the law) and trading with reliable, trustworthy buyers and sellers. Violations of policy may result in a range of actions, including:

  1. Listing cancellation

  2. Account suspension

  3. Store suspension

  4. Loss of Pro-Seller Badge or Verified Seller Badge and Certificate

  5. Limits on account privileges.

Being Truthful

We at Droom strongly believe that sellers must be truthful and transparent while selling an automobile. Sellers have access to information about the vehicle they are selling that is far superior to what a buyer can ever develop. Trying to get the best price for a vehicle based on merit is an absolutely right thing to do. But trying to get a higher price for a vehicle based on concealment of information, lying, and fabrication of information or documents is completely wrong.

In many parts of the world, there are proper legal rules that a seller must disclose any unknown problem in the vehicle he is selling if there is a reasonable way for the seller to know about those problems. For example, saying that the car engine was not repaired or that the car has not had an accident, or the car has original paint – when the seller knows for sure that the engine was repaired, the car had an accident and he was driving it or the car was repainted. Similarly, tampering with the odometer reading or covering up any other issues with artificial means for better pricing, etc. are the things that are completely wrong morally and legally. The most blatant examples of wrongdoing by sellers would be selling a stolen car or selling a car with fabricated or not genuine documents.

SELLERS AT DROOM ARE STRICTLY PROHIBITED AGAINST:

  1. Tampering with the odometer reading

  2. Cloning the vehicle, which means giving the identity of one vehicle to another vehicle of the same make, model, and color

  3. Fabricating the documents

  4. Not allowing the buyer to test drive the vehicle

  5. Lying about features or specifications

  6. Misleading or cheating the buyer by offering fake coupons or discounts

  7. Knowingly concealing the information

  8. Misusing Droom’s platform for unauthorized selling and promotions

  9. Knowingly covering issues and problems

  10. Making false promises about the extra perks like accessories or services

  11. Deliberately not answering the questions that can reveal the truth

  12. Selling a stolen vehicle

  13. Selling “cut and shut” vehicle, which means making one vehicle with two accidental vehicles

  14. Diverting from mutually agreed terms of conditions settled on Droom platform

  15. Trying to bribe the vehicle inspection expert who came to inspect the vehicle to conceal important information

PROHIBITED AND RESTRICTED ITEMS:

The following items are not allowed to be sold online at www.droom.in or the Droom Mobile App. Please note that dealers/individual sellers are solely responsible for any legal issues and other liabilities arising if you try to sell these items at Droom. We will cancel the listing of prohibited and restricted items within 24 hours after we learn of such an occurrence.

  1. Any product that doesn’t come under the automobile category

  2. Offensive Material: Examples include ethnically or racially offensive material

  3. Cloned vehicles, wherein the identity of one vehicle is given to another similar vehicle by changing the number plates

  4. Police, Army, Navy, and Air Force Related Items

  5. Cut-and-shut vehicles, wherein the remains of two vehicles (usually accidental damage) are welded together to form one vehicle, are given the identity of any of these

  6. Pre-Sale Listings

  7. A disputed vehicle with misleading disclosures and inappropriate information

  8. Prohibited Services

  9. Stolen vehicle or automobile accessories

  10. Promotional Items

  11. Replica and Counterfeit Items

  12. Ringtones

  13. Government IDs and Licenses

  14. Stocks and Other Securities

  15. Human Parts and Remains

  16. Stolen Property

  17. International Trading

  18. Surveillance Equipment

  19. Misleading Titles

Keyword Spamming Policy

Keyword spamming occurs when merchants place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing. Keyword spamming in listings is not permitted on Droom. The text sellers place in listings must be directly relevant to the item being sold.

  1. Product listing cancellation

  2. Limits on account privileges

  3. Account suspension

  4. Loss of Pro-Seller Badge, Verified Seller Badge and Certificate

Links Policy

In general, when listing items on www.droom.in dealers/individual sellers can include links that are solely intended to provide additional details about the items. This means links should only be used in circumstances where the required information can't be included in the listing itself. These links include additional images, technical specifications, manufacturer warranties, and other information that can help buyers make an informed purchasing decision. Other links that point to a third-party provider's website are also allowed, such as image hosting sites, payment processors, or courier companies.

Droom doesn't allow links to non-Droom sites or content where other items are offered for sale. Droom continuously reviews links on the site and reserves the right to block any link considered unsafe for our members. As a seller, please make sure that your listing follows the link policy of Droom. If it doesn't, it may be removed, and you may be subject to a range of other actions, including limiting your selling privileges and/or suspension of your account.

Rules about Intellectual Property

Droom is committed to protecting the intellectual property rights of the third party(s) and providing a safe marketplace to trade in. Unauthorized use or infringement of copyrighted material and trademarks is strictly prohibited at Droom.

Droom has zero tolerance for any intellectual property violations. Counterfeits, unauthorized replicas, and unauthorized items (such as fake auto accessories, stolen vehicles, or more) are not permitted at Droom. Unauthorized items include (but are not limited to) stolen vehicles, cloned vehicles, vehicles with fake identities, disputed vehicles, or false services. It is illegal to sell unauthorized items.

If the product you are selling bears the name or logo of a company, but it wasn't made or endorsed by that company, don't list it at Droom.

Pricing Policy

Please note that trust is the most important aspect of trade between buyers and sellers in a marketplace, and one of the key aspects of trust is fair pricing. For a healthy transaction flow at Droom, we ask you to price your items responsibly.

Please note that we are constantly monitoring prices for each seller on various channels and do not allow you to list your items at higher prices on Droom vs. other channels such as your own retail store, your own website (if any), or any other 3rd party retail stores or websites. You should price your items sold at Droom to be the same as the lowest rate you are selling elsewhere or even lower, but it should not be more. Violation of our pricing policy will result in warning notices and can also result in account suspension and/or store suspension.

Frequent suspensions will lead to the deactivation of your seller account on Droom’s platform.

Honesty in Listing Price

Please note that the trust you build with your buyers will go away if you artificially start showing higher prices for the listings. Artificially increasing listing prices is strictly prohibited at Droom, and any violation will result in account suspension and Droom will take appropriate actions necessary. 

Customer Communication Policy

Sellers are also not allowed to engage in direct or indirect marketing communication with buyers, however, promotions offered by Droom that benefit sellers and buyers can be promoted through direct or indirect communication with the buyers. For specific product inquiries, warranties, shipping /delivery etc., Droom can facilitate communication between buyers and sellers. However, dealers/individual sellers should not be engaged in communication with the buyers.

LIABILITIES:-

Droom is a platform connecting various buyers to dealers/sellers on www.droom.in. It is understood that Droom or any of its employees shall not be responsible or liable for any breach(s)/violations/infringement committed by a dealer/seller/individual and shall not be a party to any issues or court proceedings. Droom disclaims any/all liabilities in relation to the same. 

In case of any violations/infringement or breach(s), Droom and its management shall have the absolute discretion to take any appropriate action(s) it deems necessary against the dealer/seller/individual violating such terms. 

Any dealer/seller/individual caught violating any Droom policy(s) will be suspended for 3 weeks and all their payments will be put on hold. If a dealer/seller/individual is suspended more than 3 times, they will be permanently banned from selling at Droom in perpetuity.

Droom Order Abandonment Policy

The buyer/seller while purchasing/selling any vehicle or any other services offered on Droom shall ensure that he/she completes the order(s) on www.Droom.in. If for any reason whatsoever, the buyer/seller is unable to complete the order(s) on the website within a period of 365 days (Hereinafter referred to as the “Time period”), the order(s) shall be deemed to be abandoned and further, the buyer/seller will not be able to complete the said order(s) on the website. 

 

The website or Droom shall not be liable for any refund, cancelation or completion of the order after the said Time Period. The buyer/seller shall solely be responsible for any loss incurred by him/her after the said Time Period has elapsed. Nothing will prompt the Company or the Website to refund or complete the order(s) after the said Time Period has elapsed.

 

To avoid such situations, the Company shall make sufficient efforts to prompt the buyer to complete his/her transaction by prompting through emails and SMS within the said Time Period but after the said Time period elapses, the Company will solely have the right to act upon and terminate the order(s) in question.

 

To prompt action on the order(s), Droom shall send Emails and SMS to the buyer at specific intervals during the Time Period. The communication to the buyer will be sent in specific intervals of 30,60,90,180, and 270 days. Thereafter if there is no action from the buyer’s/seller’s end on the completion of the order(s), the order(s) shall be deemed as "Abandoned order".

Droom will not be bound to process a refund to the buyer or payout to the seller in case the order(s) is marked “Abandoned order.”

 

The order(s) that are not completed within the said Time Period shall be marked as "Abandoned order" and the buyer/seller will not be able to take further action on the order(s) and Droom shall not be responsible for any further loss/damages to the buyer/seller.

All categories of vehicle orders shall be eligible to be marked as “Abandoned orders” if they are not completed within the specific Time Period of 365 days.

This policy does not cover completed, settled, or refunded (Refund request initiated) orders.

 

Any seller caught violating Droom policy(s) will be suspended for 3 weeks and all his payments will be put on hold. If a seller is suspended more than 3 times he will be permanently banned from selling at Droom.

 

Droom's management reserves the right to amend/ modify or cancel any of the above-mentioned Policies at its own discretion. Further, Droom's management reserves the right to override this policy as and when it deems fit.
